In a story that’s causing a lot of outrage, a 21 year old Mexican man has been found not guilty of sexually assaulting a school girl because he “didn’t enjoy it.”
According to the The Guardian, gang member Diego Cruz was accused of gang raping a 17 year old girl in January of 2015. The girl told authorities that she was assaulted by the suspects on New Year’s after getting into a car with them.
The NY Post said, “Judge Anuar González found that although Cruz may have touched the girls’s breasts and penetrated her with his fingers, he had done so without ‘carnal intent’ — so was not guilty of assault”
“He sexually touched her, he vaginally penetrated her, but because he didn’t enjoy it, it’s not sexual abuse?” stated Estefanía Vela Barba, an activist on gender issues who spoke to The Guardian.“Since there was no pleasure in the act, it was intended to cause humiliation. They were touching her, they were bothering her, so for the judge, if the intention wasn’t pleasure, it’s not sexual assault,” said Vela Barba. “There’s no disputing the facts. It’s not some crazy woman saying this, it’s coming from the judge’s mouth and he’s saying that if they vaginally penetrate you against your will, it might not be abuse.”
The victim posted the following message on her Facebook in regards to the situation.
“Yes, I had a drink. Yes, I went out to party. Yes, I was wearing a short skirt, just like the majority or even all girls of my age. Am I to be judged for that? Does that mean I deserved it?”
